1. Acceptance of Terms

By accessing or using capitalloanspecialist.com (the “Site”) or submitting any loan inquiry form, you (“you” or “Consumer”) agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, do not use this Site.

These Terms constitute a legally binding agreement between you and Capital Loan Specialist, a lead generation property owned and operated by Reach Digital, LLC (“we,” “us,” or “our”). We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

 

2. Nature of Our Services — We Are Not a Lender

IMPORTANT: Capital Loan Specialist is a loan lead generation service. We are NOT a lender, broker, or financial advisor. We do not make lending decisions, extend credit, determine loan eligibility, or guarantee that you will be matched with or approved by any lender.

By submitting a loan inquiry form on this Site, you authorize us to share your information with our network of third-party lending partners who may contact you about loan products. Submission of a form does not guarantee:

  • That you will receive a loan offer
  • That any loan offer will meet your needs or expectations
  • The specific terms, rates, or availability of any loan product

Any loan agreement you enter into will be solely between you and the lending partner. We are not a party to any such agreement and assume no responsibility for its terms or performance.

 

3. TCPA Consent and Communications

3.1 Express Written Consent

By submitting a form on this Site and affirmatively checking the consent checkbox, you provide your express written consent under the Telephone Consumer Protection Act (TCPA) and applicable state laws to be contacted by Capital Loan Specialist and its network of lending partners at the phone number(s) you provide, including mobile numbers. This consent covers:

  • Telephone calls, including calls using an automatic telephone dialing system (autodialer)
  • Prerecorded or artificial voice messages
  • SMS/MMS text messages

You may be contacted even if your number appears on a federal or state Do-Not-Call (DNC) registry. Standard message and data rates may apply. Consent is not a condition of receiving any product or service.

3.2 Consent Language

The following consent language is presented to all users at the point of form submission:

“By clicking ‘Submit,’ you authorize Capital Loan Specialist and its network of lending partners to contact you about loan products and services at the email address and/or telephone number(s) you provided — including via automated telephone dialing systems, prerecorded messages, and SMS/MMS text messages — even if your number is on a federal or state Do-Not-Call list. Message and data rates may apply. This consent is not a condition of any purchase or service. You may opt out at any time.”

3.3 Opting Out

You may withdraw your consent to receive communications at any time:

  • SMS/Text: Reply STOP to any message. Opt-out is processed immediately.
  • Email: Reply UNSUBSCRIBE or contact us at team@capitalloanspecialist.com
  • Phone: Request to be removed during any call

Opt-out requests for non-SMS channels are processed within 10 business days. Note that opting out of marketing communications from us does not automatically opt you out of communications from lending partners you have separately authorized.

 

4. Eligibility

To use this Site and submit a loan inquiry, you must:

  • Be at least 18 years of age
  • Be a legal resident of the United States
  • Have a valid Social Security Number (where required)
  • Provide accurate, truthful, and complete information on all inquiry forms

By using this Site, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to refuse service to any person who does not meet these requirements or who provides false or misleading information.

 

5. Accuracy of Information Submitted

You agree to provide only accurate, current, and complete information when submitting loan inquiry forms. You acknowledge that:

  • Submitting false, misleading, or fraudulent information may violate federal and state laws
  • We rely on the accuracy of your submissions to match you with appropriate lending partners
  • We assume no liability for outcomes resulting from inaccurate information you provide

We reserve the right to reject, flag, or report any submission we reasonably believe to be fraudulent or in violation of applicable law.

 

6. Advertising Disclosure and Compensation

Capital Loan Specialist is a for-profit lead generation business. We receive compensation from lending partners when we refer consumers to them, regardless of whether a loan is ultimately issued. This compensation may influence:

  • Which lending partners we work with
  • How loan products are presented on this Site
  • The order in which lenders or products may appear

Our services are provided to you at no direct cost. We do not charge consumers a fee for submitting a loan inquiry or for being connected with lending partners. Any fees associated with a loan product are between you and the lending partner.

 

7. Privacy, Data Collection, and Use

Your use of this Site is subject to our Privacy Policy, available at capitalloanspecialist.com/privacy-policy, which is incorporated into these Terms by reference.

By submitting a loan inquiry, you acknowledge and agree that:

  • We collect sensitive financial and personal information as described in the Privacy Policy
  • We share your information with our network of lending partners for the purpose of fulfilling your loan inquiry
  • We use third-party tracking technologies including NextRoll (AdRoll) and Facebook Pixel for advertising and analytics purposes
  • You may opt out of certain data uses as described in the Privacy Policy

We implement industry-standard security measures to protect your data. However, no method of electronic transmission is 100% secure. By using this Site, you acknowledge and accept this inherent risk.

 

8. Cookies and Tracking Technologies

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAPITAL LOAN SPECIALIST, REACH DIGITAL, LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Your use of or inability to use this Site
  • Any loan product offered by a lending partner
  • Any decision you make based on information obtained through this Site
  • Unauthorized access to or alteration of your information
  • Any other matter relating to this Site or our services

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THIS SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before initiating any formal dispute, you agree to contact us at team@capitalloanspecialist.com to attempt to resolve the issue informally. We will attempt to resolve the dispute within 30 days of receiving your written notice.

16.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of this Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16.3 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm, or to enforce intellectual property rights.

 

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Broward County, Florida.

 

18. California Consumer Rights (CCPA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, correct, and opt out of the sale or sharing of your personal information. Please refer to Section 11 of our Privacy Policy for a full description of your CCPA rights and how to exercise them.

19. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Capital Loan Specialist with respect to your use of this Site and supersede all prior or contemporaneous agreements, representations, and understandings.
